Elektra Theme Terms and Conditions

 

These terms and conditions (the "Terms") govern the purchase and use of the website theme (the "Theme") provided by Two West and Front Matter, Canadian registered companies (the "Provider"), to the purchaser (the "Customer"). By purchasing and using the Theme, the Customer agrees to be bound by these Terms. If you do not agree with any part of these Terms, you may not purchase or use the Theme.

  • License Grant:
    • The Provider grants the Customer a non-exclusive, non-transferable license to use the Theme on a single website domain. The Customer may not sublicense, sell, distribute, or otherwise transfer the Theme to any third party.
  • Theme Usage:
    • The Theme is intended for use on websites owned or controlled by the Customer. The Customer may modify the Theme to suit their website's specific requirements.
  • Support and Updates:
    • Theme purchase includes documentation and critical updates related to the core theme.  Support for the stock theme is included for the first year. Please reach out to discuss support beyond the first year or for customized Elektra themes.
  • Intellectual Property:
    • The Theme, including all its design, code, and associated materials, remains the intellectual property of the Provider. The Customer may not claim ownership of any part of the Theme.
  • Warranty:
    • The Theme is provided "as is," and the Provider makes no warranties, either express or implied, regarding its performance, fitness for a particular purpose, or non-infringement.
  • Refunds:
    • The purchase of the website theme is a final sale. 
  • Liability:
    • The Provider shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Theme.
  • Third-Party Components:
    • The Theme may include third-party components, such as libraries, plugins, or fonts, subject to their respective licenses. The Customer must comply with those licenses when using the Theme.
  • Security:
    • The Customer is responsible for ensuring the security and confidentiality of their website and any user data. The Provider shall not be liable for any security breaches or data compromises.
  • Prohibited Uses:
    • The Customer may not use the Theme for any illegal, defamatory, or unethical purposes. The Theme may not be used in a manner that infringes upon the rights of any third party.
  • Changes to Terms:
    • The Provider reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Provider's website.
  • Governing Law:
    • These Terms shall be governed by and construed in accordance with the laws of Canada, and any disputes shall be subject to the exclusive jurisdiction of the courts in British Columbia, Canada

 

By purchasing and using the Theme, the Customer acknowledges that they have read, understood, and agreed to these Terms and will abide by them during the course of their use of the Theme.
